Diversified Electronics Inc Diversified has several plants throughout the United States, all of which are unionized. Dan Devout, a fervent Adventist, works in the Diversified plant. For the purpose of this question,
assume that the Adventist religion is legally recognized. As Dan lacks seniority in his job, he was assigned to the evening shift on the production line, which required him to work on Friday nights. Dan- religion prohibits him from working from sundown Friday until sundown Saturday. Eventually, Dan was
fired for his continuing Friday night absence from work. Accommodating Dan would have required Diversified to use a floater to replace Dan every Friday night. This would mean that Diversified would have to forgo using the floater elsewhere or hire another floater. Also, more repairs and lower efficiency are
likely when a floater is used.
Dan sued Diversified, claiming religious discrimination. Diversified defended claiming that Dan was not fired for religious discrimination but for absenteeism.
